These Terms & Conditions ("Terms") govern your use of the NXT LVL Softball website and your participation in or purchase of any programs, services, events, training, leagues, camps, clinics, lessons, recruiting services, or other offerings provided by NXT LVL Softball ("NXT LVL," "we," "us," or "our").

By accessing our website, creating an account, submitting a registration, purchasing a service, or participating in a NXT LVL Softball program or event, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, please do not use our website or participate in our programs or services.

About NXT LVL Softball

NXT LVL Softball provides softball-related training, instruction, development, competition, camps, clinics, leagues, recruiting education and support, and other athletic services.

Program details, schedules, locations, pricing, eligibility requirements, and other information may vary by offering and will be communicated during the registration or enrollment process.

NXT LVL Softball reserves the right to modify program details when reasonably necessary due to scheduling, facility availability, weather, staffing, safety concerns, or other circumstances.

Eligibility & Registration

Certain programs may have age, skill-level, position, team, or other eligibility requirements. By registering a participant, the registering individual represents that they are authorized to register the participant and provide any information required for participation.

Parents or legal guardians are responsible for registering minors and agreeing to these Terms on their behalf.

Participants and their parents or guardians are responsible for providing accurate and current registration information.

NXT LVL Softball reserves the right to deny or cancel a registration if a participant does not meet the requirements of a particular program.

Payments & Fees

All program fees, registration fees, deposits, and other charges must be paid according to the terms presented during registration or purchase.

Prices are subject to change, but the price displayed at the time of purchase will generally apply to that transaction.

NXT LVL Softball reserves the right to require payment in full, deposits, payment plans, or other payment arrangements depending on the program.

Failure to make required payments may result in removal from a program, cancellation of registration, or loss of participation privileges.

Refunds & Cancellations

Refunds and cancellations are governed by the NXT LVL Softball Refund & Cancellation Policy, which is incorporated into these Terms by reference.

Unless otherwise stated for a specific program, registration fees, deposits, and payments may be non-refundable once a registration has been confirmed.

Participants should review the Refund & Cancellation Policy and any program-specific cancellation terms before completing registration.

Schedule Changes & Weather

Softball activities and other athletic programs may be affected by weather, field conditions, facility availability, staffing, or other circumstances outside of NXT LVL Softball's control.

NXT LVL Softball may modify, postpone, reschedule, relocate, shorten, or cancel activities when reasonably necessary.

When possible, we will provide notice of significant schedule changes and attempt to offer a rescheduled activity, credit, refund, or other appropriate resolution when applicable.

Participant Conduct

NXT LVL Softball is committed to providing a positive, respectful, competitive, and development-focused environment.

Participants, parents, guardians, coaches, and spectators are expected to conduct themselves appropriately and respectfully.

Prohibited conduct may include:

Bullying, harassment, discrimination, or intimidation
Threatening, abusive, or inappropriate behavior
Fighting or physical aggression
Disrespect toward coaches, officials, staff, athletes, or other families
Intentional damage to facilities or equipment
Repeated disruption of instruction or competition
Behavior that creates an unsafe environment

NXT LVL Softball reserves the right to remove an individual from a program, event, facility, or activity for inappropriate or unsafe behavior.

Inappropriate conduct may result in dismissal without a refund.

Athlete Safety & Participation

Participation in athletic activities involves inherent risks, including but not limited to falls, collisions, contact with equipment, overuse injuries, weather-related conditions, and other injuries.

Participants and their parents or legal guardians are responsible for determining whether the participant is physically able to participate in a particular activity.

NXT LVL Softball may restrict or discontinue an athlete's participation when we reasonably believe participation presents a safety concern.

Participants should notify a coach or NXT LVL Softball staff member of any injury, illness, or condition that may affect their ability to safely participate.

Assumption of Risk

By participating in NXT LVL Softball activities, participants and their parents or legal guardians acknowledge that athletic activities involve inherent risks.

To the extent permitted by applicable law, participants and their parents or legal guardians voluntarily assume the ordinary risks associated with participation in athletic activities.

Participation does not guarantee that an athlete will remain free from injury.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.

Medical Emergencies

In the event of an emergency, NXT LVL Softball may take reasonable steps to obtain emergency medical assistance for a participant.

Parents and legal guardians are responsible for ensuring that emergency contact and medical information provided during registration is accurate and current.

NXT LVL Softball is not responsible for costs associated with emergency medical treatment.

Photography, Video & Media

NXT LVL Softball may photograph or record activities, events, practices, games, camps, clinics, or other programs for promotional, educational, social media, website, or marketing purposes.

Any use of a participant's image or likeness will be subject to the permissions and releases provided during registration or separately obtained by NXT LVL Softball.

If a participant or parent/guardian has questions regarding media use or applicable permissions, they should contact NXT LVL Softball.

Intellectual Property

All content appearing on the NXT LVL Softball website, including but not limited to logos, trademarks, graphics, photographs, videos, written content, program materials, training materials, designs, and other original content, is owned by or licensed to NXT LVL Softball unless otherwise stated.

You may not copy, reproduce, distribute, modify, sell, publish, or otherwise use NXT LVL Softball content for commercial purposes without prior written permission.

NXT LVL Softball's name, logos, branding, and other identifying materials may not be used without permission.

Website Use

You agree to use the NXT LVL Softball website only for lawful purposes.

You may not:

Attempt to gain unauthorized access to the website or its systems
Interfere with the operation or security of the website

Recruiting Services & Information

NXT LVL Softball may provide recruiting education, workshops, consultations, evaluations, metrics, skills videos, recruiting strategy sessions, and other recruiting-related services.

These services are intended to provide education, guidance, and support. NXT LVL Softball does not guarantee that an athlete will receive a scholarship, roster spot, offer, admission, professional opportunity, or other specific recruiting outcome.

Recruiting decisions are made independently by colleges, universities, coaches, organizations, and other third parties.

No Guarantee of Athletic Results

Participation in NXT LVL Softball programs does not guarantee a specific athletic outcome, performance improvement, roster position, playing time, tournament result, recruiting opportunity, scholarship, or other result.

Athletic development depends on many factors, including individual effort, ability, attendance, health, experience, competition, coaching, and circumstances outside of NXT LVL Softball's control.

Privacy

Your use of the NXT LVL Softball website and services may involve the collection and use of personal information.

If a program-specific agreement conflicts with these Terms, the program-specific terms will control to the extent of the conflict.
